Welcome to Blue Arc. These Terms of Service (“Terms”) govern your use of bluearcwelds.com (the “Website”) and any purchase you make from us. By browsing the Website, creating an account, requesting a quotation or placing an order, you agree to these Terms. If you do not agree, please do not use the Website.

Who can use the Website

You must be at least 18 years old and legally able to enter into a binding contract to place an order. If you are ordering on behalf of a company or other organisation, you confirm that you are authorised to bind it to these Terms.

You agree to provide accurate, current and complete information when creating an account, requesting a quotation or placing an order.

Your account

You are responsible for keeping your login details confidential and for all activity that takes place under your account. Tell us immediately if you suspect unauthorised use. We may suspend or close an account that is used in breach of these Terms.

Products and information

We take care to describe and display our products accurately. However:

• Product images are for illustration, and colours, finishes and packaging may differ slightly from what you see on screen
• Technical specifications are based on manufacturer data and may be updated or improved without notice
• All products are subject to availability, and we may limit quantities or discontinue a product at any time

If a product you ordered is materially different from its description, you may return it under our Refund Policy.

Orders and acceptance

Placing an order is an offer to buy the products in your cart. The automatic order confirmation email acknowledges that we have received your order; it does not mean the order has been accepted. A contract is formed when we confirm that the order has been dispatched or is ready for collection.

We may decline or cancel an order, in whole or in part, for reasons including lack of stock, a pricing or description error, failure to verify payment or suspected fraud. If we cancel an order you have paid for, we will refund you in full.

Delivery

Delivery areas, timeframes and charges are set out in our Shipping Policy, which forms part of these Terms. Delivery dates are estimates, and we are not liable for delays caused by events outside our reasonable control. Responsibility for the products passes to you on delivery or collection, and ownership passes once we have received payment in full.

Returns, refunds and cancellations

Returns, exchanges, refunds and order cancellations are governed by our Refund Policy, which forms part of these Terms.

Warranty

Blue Arc welding machines and plasma cutters are covered by a 2-year warranty against defects in materials and workmanship. The full warranty terms, including what is not covered and how to make a claim, are set out in our Refund Policy.

Except for this warranty and any rights you have under UAE law that cannot be excluded, products are supplied without any other warranty, express or implied.

Safe use of products

Welding and cutting equipment is professional equipment that can cause serious injury, fire or property damage if used incorrectly. By purchasing from us, you agree that:

• Products will be installed, operated and maintained only by trained and competent persons, in line with the user manual and the rating plate of the machine
• You will provide a suitable power supply, earthing, ventilation and working environment
• Operators will use appropriate personal protective equipment and follow all applicable health, safety and site regulations
• You are responsible for confirming that a product is suitable for your intended application

Any technical advice or product recommendation given by our team is offered in good faith as general guidance. It does not replace the user manual, a qualified engineering assessment or your own judgement.

Intellectual property

All content on the Website – including the Blue Arc name and logo, text, product descriptions, images, videos, graphics and software – is owned by or licensed to Blue Arc and is protected by intellectual property laws. You may view and print content for your own purchasing purposes. You may not copy, reproduce, republish, modify or use it commercially without our prior written consent.

Acceptable use

You agree not to:

• Use the Website for any unlawful or fraudulent purpose
• Attempt to gain unauthorised access to the Website, its servers or other users’ accounts
• Introduce viruses or other harmful code, or interfere with the normal operation of the Website
• Use automated tools to scrape, copy or harvest content or data from the Website
• Submit false, misleading or offensive information through any form on the Website

Third-party links and services

The Website may contain links to third-party websites and uses third-party services, such as payment providers and delivery carriers. We do not control these third parties and are not responsible for their content, policies or services.

Disclaimer

The Website and its content are provided on an “as is” and “as available” basis. We do not guarantee that the Website will be uninterrupted, error-free or free from harmful components, and we may change, suspend or withdraw any part of it without notice.

Limitation of liability

To the fullest extent permitted by law, Blue Arc is not liable for any indirect, incidental or consequential loss, or for any loss of profit, revenue, production, business or data, arising from your use of the Website or of any product purchased from us.

Our total liability for any claim relating to a product is limited to the amount you paid for that product.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the laws of the United Arab Emirates.

Indemnity

You agree to compensate us for any loss, damage, claim or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Website or your use of any product contrary to its user manual or to applicable safety regulations.

Events outside our control

We are not responsible for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, severe weather, government action, customs or port delays, carrier disruption, supplier shortages, power or internet outages, strikes and public health emergencies.

Privacy

We collect and use your personal information as described in our Privacy Policy, which forms part of these Terms.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date and will apply to orders placed after that date. The Terms in force when you placed your order apply to that order.

General

If any part of these Terms is found to be invalid or unenforceable, the remaining parts continue to apply. If we do not enforce a right under these Terms, this does not mean we have waived it.

These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, are the entire agreement between you and us regarding your use of the Website. Where a signed quotation or supply contract between you and Blue Arc contains different terms, that document takes priority for the order it covers.
